2.- USERS: Access to or use of this website by the USER implies his or her consent to and acceptance of General Terms and Conditions of Use detailed herein. The aforementioned terms and conditions shall apply regardless of the mandatory General Terms and Conditions of Contract, where applicable.
3.- USE OF THE WEBSITE: www.engilang.com provides access to the USER to a variety of information, services or data (hereinafter “content”) pertaining to LD or its customers. The USER assumes total responsibility for the use of the website and will register, if necessary, to access certain services or contents. During the registration the USER will be responsible for providing true and legitimate information. As result, the USER can be provided with a password for which he or she will be responsible, pledging to make diligent and confidential use of it. The USER undertakes to make use of the content and services on this website in a suitable, proper and legal manner, and, including but not limited to, (i) not to engage in illicit activities, illegal or contrary to good faith and public order; (ii) not to disseminate content or propaganda of racist, xenophobic, pornographic, illegal character, terrorism apology or attempting against human rights; (iii) not to provoke damage in the physical and logical systems belonging to LD, its suppliers or third parties, or introduce or spread any type of computer virus or any other physical or logical systems that are capable of causing the aforementioned damage; (iv) not to attempt to access and, if applicable, use the email accounts of other users and modify or manipulate their messages. LD reserves the right to remove any remarks and contributions that infringe respect for personal dignity, be they discriminatory, xenophobic, racist, pornographic, or which threaten youth or infants, public order or security or which, in LD’s opinion, are not suitable for publication. In any case, LD will not be responsible for any opinions expressed by users in forums, chats or other participatory tools.
4.- PRIVACY POLICY: LD complies with the Organic Law 15/1999 of December 13 on Protection of Personal Data, the Royal Decree 1720/2007 of 21st of December, approving the Regulation that develops the LOPD, whose purpose is to prevent the changing, loss, processing or unauthorised use of personal data of the user. To this end, it shall inform the USER of the existence and the acceptance of the specific conditions for treatment of their data in each case along with each formula collecting personal data, in the services that the USER may request from LD, informing the USER of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation, or opposition, the purpose of the treatment and any communication of data to third parties, where applicable. In addition, LD informs that it complies with the Law 34/2002 of July 11, regarding Services of the Information Society and E-Commerce and will at all times ask for the USER’S consent to the treatment of his or her electronic mail with commercial purposes.
5.- INTELLECTUAL and INDUSTRIAL PROPERTY: LD, per se or as a lessor, owns all intellectual and industrial property rights of its webpages, as well as the items contained therein (including but to limited to, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of used materials, computer programs necessary for its functioning, access and use, etc.), ownership of LD or its lessees. In pursuance of the provisions in Articles 8 and 32.1, second paragraph, of the Intellectual Copyright Act, it is expressly forbidden to reproduce, distribute and disseminate publicly, including the making available modality, of all or part of the contents of the website for commercial purposes, in any format and by any technical means, without prior authorisation of LD. The USER agrees to respect the intellectual and industrial copyright pertaining to LD. He or she can view the items of the various websites and even print, copy and store them in their computer hard drive or in any other physical medium provided that it is purely and exclusively for their personal and private use. The USER must refrain from deleting, altering or manipulating any protective device or security system installed in the LD’s webpages.
6.- RESPONSIBILITY AND GUARANTEE DISCLAIMER: LD takes no responsibility, under any circumstances, for harm or damage of any kind that may be caused by, but not limited to, the following: errors or omissions in the content, lack of availability of the portal, correct visualization, or the transmission of viruses or programmes that are malicious or harmful in their content, in spite of having adopted all the necessary technological measures to avoid such occurrences.
7.- MODIFICATIONS: LD reserves the right to carry out, without prior notice, any changes to its websites it considers appropriate, being able to delete or add both content and services the websites offer, as well as the way in which the contents and services are presented or located on its websites.
8.- LINKS: In the case of the websites having links or hyperlinks towards other Internet sites, LD shall not exert any kind of control over those sites and contents. In no case shall LD assume any responsibility for the contents of any link belonging to an outside website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, veracity, validity and constitutionality of any material or information contained in any of the hyperlinks or other Internet sites. The relationship between LD and the USER will be governed by the current Spanish regulations and any controversy will be submitted to the courts and tribunals of the city of Alicante.
